***HEALTH AND GENETIC WARRANTY FOR YOUR PUPPY***
THE FOLLOWING WARRANTY IS A REPLACEMENT WARRANTY FOR PROBLEMS DIAGNOSED ASSOCIATED WITH LIFE THREATENING PROGNOSIS ONLY.
Mason Creek Kennel “MCK”, pups4all and/or preciouslittletreasures.com shall hereinafter be referred to as the SELLER. The original purchasing party, and solely the original purchasing party, shall hereinafter be referred to as the BUYER.
This warranty / contract is non-transferable.
SELLER promises and guarantees to deliver the exact puppy reserved for BUYER during BUYER’S reservation of puppy. Deposits are nonrefundable. SELLER will only refund BUYER’S deposit if for any reason Seller is unable to deliver the puppy reserved by BUYER. Buyer will have the option to pick from an alternate choice of puppy which Seller has available if Buyer so chooses.
1. BUYER'S failure to comply with any or all of the warranty stipulations below will automatically null and void the warranty...warranty will automatically be dissolved and Seller will be immediately and completely released of warranty obligations to the BUYER. The BUYER must have the puppy examined by a licensed veterinarian within two (2) business days of receiving puppy. SELLER must be informed immediately of the initial vet examination by email: ppassion@charter.net. If BUYER’S vet establishes a MAJOR problem with the puppy upon initial examination, which would identify the puppy as “life-threatened”, then the BUYER should initiate a claim for puppy. BUYER should return puppy to SELLER per instructions of SELLER, and at Buyer’s expense. All transportation costs for a replacement puppy will be at BUYER’S EXPENSE. SELLER reserves the right to have BUYER’S vet speak with SELLER’S vet per SELLER’S request at any time. Seller also reserves the right to have puppy examined by SELLER’S vet of choice, before any exchange is agreed upon or initiated. If SELLER’S vet assesses a diagnosis contrary to BUYER’S vet, SELLER will not be deemed further liable to the warranty claim. The value of the puppy for the purpose of this guarantee is solely the original purchase price of puppy, excluding the cost of shipping/ vet certification /airline approved crate and does not include any additional prices declared by the BUYER. BREEDER/SELLER MUST OPERATE IN ACCORDANCE TO THE FINDINGS OF THE LICENSED VETERINARIAN WHO EXAMINES PUPPY FOR VET CERTIFICATION and DETERMINATION OF PUPPY’S COMPLETE HEALTHY STATUS PRIOR TO SHIPPING. BUYER AGREES TO HOLD THE VETERINARIAN WHO EXAMINED PUPPY FOR VET CERTIFICATION PRIOR TO SHIPPING ACCOUNTABLE FOR ANY MISSED DIAGNOSES OR PROBLEMS WHICH BUYER BELIEVES SHOULD HAVE BEEN DETERMINED OR DIAGNOSED WHILE WITH SELLER AND BUYER WILL NOT HOLD BREEDER OR SELLER RESPONSIBLE.
2. DETAILS ON REPLACEMENTS: In the event of death of the puppy, within the extended period of the warranty, which is caused by confirmed genetic defect, the SELLER shall replace the pet with another of equivalent value within a period of six (1) YEAR. In the event of puppy’s death, and at the BUYER’S expense, the BUYER is required to contact the closest State Agricultural Diagnostic Lab (“SADL”) on the date of puppy’s death… for instructions regarding forwarding the puppy for an autopsy to determine the exact cause of death. An autopsy performed by your “SADL” provides the most detailed, unbiased, and inexpensive evaluation available for proof of cause of death. Your vet or STATE DEPT. OF AGRICULTURE can provide the contact information for you. A copy of the complete autopsy findings should be forwarded to SELLER as soon as the report is available. The BUYER would qualify for a replacement puppy upon conclusive genetic defect. Absolutely no warranty is implied for any type of injury to puppy or health problems occurring as a result of injury and/or negligence by BUYER. SELLER does not warranty the puppy against sugar drops…”Hypoglycemia” or other non-life threatening illnesses common to puppies. It is the BUYER’S responsibility to ensure that their new puppy eats often and to avoid long periods of time between feedings. All transportation costs for a replacement puppy will be at BUYER’S EXPENSE.
3. TO MAKE A CLAIM FOR REPLACEMENT PUPPY: BUYER must return puppy to SELLER at BUYER’S expense and according to SELLER’S SPECIFICATIONS. Copies of all vet records, all registration papers, and other records such as warranty etc. should be returned to SELLER upon submitting a claim for replacement. All registration papers will need to be properly transferred back to SELLER and SELLER will instruct BUYER with this effort. BUYER must return all registration papers/ applications to SELLER and sign all papers necessary to transfer ownership of pup back to SELLER, at BUYER’S expense, at time of return of puppy. If mailed, all returning paperwork shall be returned to SELLER via certified postal mailing… If BUYER cannot provide return of all aforementioned paperwork, this contract will be invalidated and a claim for replacement will be denied. All transportation costs for a replacement puppy will be at BUYER’S EXPENSE.
4. Breeder retains all rights to determine the exact time of shipping for puppy and must feel comfortable that the puppy is completely ready for the new home transfer vs. travel requirements if shipped. Breeder will attempt to coordinate a ship date as close to the one mutually agreed to by BUYER and SELLER upon reservation, but if for any reason the breeder /SELLER feels a delay in ship date is in the best interest of puppy, BUYER will understand breeder is acting in best interest of the puppy. Federal mandates require puppy to be at least 8 wks of age for shipping purposes, but we will not ship puppies until our vet determines the puppy is viable in as much to tolerate the transportation and change of homes well. Teacup sized puppies will generally not be ready for shipping until 10 wks of age at the earliest. If our vet suggests for any reason that any puppy should not be shipped on the tentatively scheduled ship date or breeder feels the puppy needs a delayed ship date for any reason, we will notify new owner as to the reason why and reschedule accordingly. BUYER understands and agrees to this as SELLER will not knowingly ship a puppy that is not ready for shipping… for any reason.
GENERAL TERMS, WHICH APPLY TO THE WARRANTY OF SAID PUPPY:
Any chosen form of reimbursement and/or refund from SELLER invalidates further claims from BUYER to the health/genetic warranty provided for the puppy(ies).
Seller will retain the right to evaluate exactly what age each puppy will be determined as ready for the change of home vs. the trip via shipping. Seller must retain the liberty to delay shipping date if Seller feels the puppy should have more time to ensure safe shipping for the puppy and the ultimate, problem-free introduction into the new home or for any reason Seller determines is in the puppy’s best interest. Seller must retain the right to act in the best interest of the puppy and if ship date has to be delayed, Buyer will not hold this as grievance against Seller. . . deposits are nonrefundable.
1. BUYER should immediately contact their vet should any symptom of illness or injury be noted during the time of the warranty.
2. UPON ENTERING THE NEW HOME…give new puppy plenty of time for rest…DON’T OVERSTRESS WITH TOO MUCH ACTIVITY. Allow for gentle adjustment to the new home and surroundings. Give lots of praise, attention and supportive measures until puppy settles into the new home.
3. BUYER must keep puppy under the regular care of a licensed vet during the length of warranty. Normal vet care protocol must be provided by a licensed vet governed by the recommendations and guidelines of THE AMERICAN VETERINARIAN MEDICAL ASSOCIATION. The BUYER is responsible for the daily health care and maintenance of the pet, including but not excluding all recommended care such as: immunizations and examinations recommended after purchase, as well as providing necessary medication and follow-up treatments from veterinarian visits.
4. BUYER will not hold SELLER responsible for any dispute concerning accuracy of puppies produced from hybrid breeds, the parentage thereof, the breed standards thereof, etc. after the reservation and/or sale. Breed standards vary greatly when breeds are mixed and BUYER will not contest validity of hybrid breeds after the sale. BUYER will not hold SELLER liable for any dispute after sale which involves question of hybrid breed confirmation or validation. SELLER will not be liable for any post-sale complaints concerning breed authentication of hybrid mixes and BUYER agrees to accept a hybrid puppy “as is” upon reservation and /or purchase of puppy to satisfy all perimeters of the sale and contract should puppy change in appearance with age or any fabricated question of hybrid breed authentication arise after the sale. BUYER agrees to never request or require any hybrid breed authentication verification from SELLER after the sale, including DNA testing. BUYER agrees to accept their hybrid puppy based upon the appearance of puppy at time of reservation and/or purchase and acknowledge complete satisfaction of the hybrid breed puppy as was promoted and / or advertised by SELLER. BUYER SHOULD AGREE TO LOVE PUPPY FOR THE DURATION OF LIFETIME BASED SOLELY UPON BUYER’S BELIEF THAT THIS PUPPY FULLFILLED ALL REQUIREMENTS NEEDED TO COMMIT TO THIS PUPPY FOR A LIFETIME OF LOVE, CARE AND SATISFACTION.
5. BUYER will be responsible for cost of any need for duplicated processing of registration papers. BUYER must hold the original breeder responsible for production of registration papers for any puppy which SELLER is not the original breeder. Upon elective option of SELLER to provide alternate and/or substituted registration for purchased puppy, BUYER agrees to accept registration from an alternate registry if original registration status upon purchase cannot be fulfilled and or provided by SELLER for any reason. Any need for provision of alternate /substituted registration will be optional at the elective discretion of Seller. BUYER will not hold MCK/SELLER responsible for CKC or AKC changes in registration status of purchased puppy and /or DNA verification matters of purchased puppy which alters registration status of purchased puppy at any time. Buyer agrees to never attempt registration of their puppy with ANY OTHER registry which SELLER did not allow rights for at time of reservation and/or purchase since registration status developed sale price for puppy at time of sale. Breeding rights and registry allowed with sale of puppy will be documented on warranty.
6. BUYER will be responsible for pursuing any and all grievances with the airlines or any other providers of transportation for settlement of all concerns until thoroughly exhausted. BUYER shall not deem SELLER liable for any problem associated with the services of the transportation provider. BUYER will be responsible for any unexpected, additional fees required by provider… above and beyond the fee BUYER agreed upon for shipping of animal at time of reservation. BUYER will be responsible for any unexpected additional fees required by transportation provider.
7. SELLER can make no guarantee as to the projected adult size, conformation, adult color, hybrid breed verification or that the BUYER will be able to show or breed this puppy or that puppy/puppies will be judged or appraised as show quality. Breeder can not guarantee success in the show ring even if show quality or potential is assessed at time of sale. SELLER will not be held liable for pre-exiting conditions of puppy, diagnosis of same or disclosure of same to BUYERS…the SELLER can not always be aware of every single problem that might exhibit at any point after the sale. Puppies sold for Pet Companionship, Breeding Rights, and / or Show Potential will not be perfect specimens by no standard of evaluation therefore SELLER will not be liable if puppy possesses any flaw which BUYER may use after sale to deem the puppy as “LESS THAN A PERFECT SPECIMEN”. BUYER is simply responsible to view the puppy from outward appearance and personality to determine if puppy constitutes all BUYER needs to know in order to choose their puppy of preference for lifetime commitment, love, and care regardless if any flaw may surface or come to BUYER’S awareness at anytime after the sale.
8. If BUYER determines they are unable to keep puppy for any reason, BUYER will notify SELLER first with the option to purchase said puppy back before any other party is allowed to purchase the puppy. All paperwork and registration papers will need to accompany the puppy with signatures that transfer the puppy back to SELLER.
9. BUYER AGREES THAT VACCINATIONS WILL NOT BE REPEATED WITHIN A 2 WEEK PERIOD FROM THE LAST DOCUMENTED VACCINATION RECEIVED WHILE AT MCK. THIS COULD PLACE THE PUPPY AT RISK.
10. If BUYER cancels reservation of a puppy at anytime prior to shipping or transfer of ownership, refund will be completed by SELLER upon resale of the puppy or at a timely manner per discretions of SELLER. Nonrefundable deposit will be half of purchase price plus micro-chipping fee when it applies.
11. SELLER is neither responsible nor liable for any expenses of this puppy once puppy is released by SELLER to transportation representatives for delivery to BUYER and/or upon Buyer’s ownership/possession of puppy. SELLER disclaims any and all implied warranties of merchantability and fitness. BUYER agrees that the situs of this agreement is the state of
12. BUYER agrees to sections A and B of MCK PUPPY RESERVATION EMAIL AND WARRANTY which will be provided for each BUYER after reservation and/or upon purchase of a puppy. BUYER MUST PURCHASE ALL PRODUCTS AS DISCUSSED IN PUPPY CARE, FEEDING AND HOUSETRAINING SECTIONS OF MCK PUPPY RESERVATION EMAIL AND WARRRANTY AND WEBSITE, THEN ATTACH ALL RECEIPTS TO WARRANTY. . . Failure to do so will void contract and warranty.
WARRANTY IS SUBJECT TO CHANGES AT ANY TIME.
